out by Sworn Translators of all contracts, property deeds, powers of attorney,
court decisions, certificates, wills and generally any document related to
the real estate and other services we offer.

Real Decreto
26 January 1996, num.:79/1996 (BOE 23/2/96) Change of rules. Art.13 of the
rules and regulations of the " Oficina de Interpretaciòn de Lenguas" (Language
Interpreting Office) approved by Real Decreto 2565/1977 on the 27th August
will state as follows:
"Verbal or written translations, from a foreign language into Spanish and
vice versa, carried out by Sworn Translators will be held as the official
version and written ones can be submitted for revision to the "Oficina de
Interpretaciòn de Lenguas" when authorities decide to do so. Sworn Translators
can certify the accuracy of their translation by stamping and signing it."
Translations carried out by Sworn Translators can only be revoked by the "Oficina
de Interpretaciòn de Lenguas" of the Ministry of Foreign Affairs by starting
a proceeding

Residence Rights
As an EC citizen you are entitled to reside in any EC country whatever your
social, economical or professional status. However this right has several
limitations and conditions that you should be aware of…
Limited stay in an EC country
You always have the right to visit an EC country on holiday or if your company
transfers you for a short period.
Permanent Residence and Work Permit
You have this right if you are self-employed or employed by a company in an
EC country. If you are a student or a pensioner (and you move to a different
country) you are entitled to Spanish residency but you have to:
1. Be financially independent
2. Have valid health insurance. For E C and non EC residents If you buy property
in Spain.
You are entitled to Spanish residency but you have to:
1. Be financially independent or demonstrate you have a regular income
2. Have valid health insurance.
This rule applies so you do not have to be supported by the social services
of the guest country. The rule does not apply if you have worked in the guest
country and you have retired there.

Becoming a Resident:
If you wish to spend more than 183 days per year in Spain you will need to
apply for a Residencia to become registered as a Resident. Being a resident
does not restrict your movements in any way you will be able to spend as much
or as little time in Spain as you wish, there are no restrictions, but there
are many advantages. Registering as a resident in Spain, in no way changes
your nationality.
If you are not to become a Resident you must appoint a fiscal representative
who is, your Asesor would be a good choice, This is not a responsibility that
should be entrusted to an amateur friend or neighbour. Good reasons for becoming
a resident:
The are many advantages, some of the major ones are:
1. If you are resident and more than 65 years old, and you have lived in your
home for at least 3 years, you will not be liable to Spanish capital gains
tax when you sell it, no matter how much profit you make [Non residents will
be taxed at up to 5%]
2. If you are a resident, the maximum capital gains tax will be 20% or less
[non residents pay 35%]
3. If you are a resident and you sell your primary residence in Spain and
invest your profit into a more expensive property which will also be your
primary residence in Spain, you will not have to pay any capital gains tax
at all.
4.If you are resident and you sell your property, you will not be subject
to having 5% of the total declared selling price withheld as a guarantee
against possible tax liabilities [non residents will have 5% withheld,
and if no liabilities are found, your abogado will be able to retrieve
it in around 12 months]
5.If you are a resident and will your home to your spouse or child who is
also a resident, then Spanish inheritance tax can be avoided on 95% of the
valuation, providing that you have owned and lived in the property for at
least 3 years, and the inheritor undertakes not to sell the property for 10
years and continue to be a resident. The cut off point for the 95% reduction
is 120,200 euro, over that amount you must pay.
